PLEASE READ THIS AGREEMENT BEFORE INSTALLING FARECO ARCHIVE.
By selecting "I accept the agreement" in the installer and continuing, you agree to this End User License Agreement ("EULA"). If you do not agree, decline the agreement and do not continue installation. Your purchase and refund rights are governed by the applicable Terms of Sale.
1. YOUR SOFTWARE LICENSE
When you lawfully obtain FareCo Archive - Founding Edition, Innovative Mktg LLC ("FareCo," "we," or "us") grants you a nonexclusive, perpetual license to use the purchased Founding Edition software, subject to this EULA.
The license is for one household, with up to two concurrently registered devices and up to four lifetime device activations under the applicable device policy. Legitimate computer replacements and activation-limit issues may be reviewed through FareCo support. Additional activation resets are not automatically guaranteed.
This is a license to use the software, not a transfer of ownership of FareCo's software or underlying intellectual property. Ordinary non-AI Core Archive use does not require a subscription or recurring license fee. Your perpetual license does not expire when Included AI assistance ends.
2. ACTIVATION AND OFFLINE CORE USE
Initial activation requires an internet connection and a valid license key. FareCo's activation service verifies the license and registers the device using applicable device-verification information.
The Sample Archive may be explored without activation. A valid activation is required for Private Archive access and editing. After valid activation, ordinary non-AI Core Archive functions can operate locally without continuous internet access or recurring online license verification. Local license checks still apply.
3. YOUR ARCHIVE MATERIALS
Your original photographs, videos, documents, metadata, and other archive materials remain yours, subject to the rights you already hold in them. Using FareCo Archive does not transfer ownership of those materials to FareCo.
You are responsible for having any necessary rights to materials you import or use. Maintain independent backups of important materials. A separate hosted archive-backup service is not included with the Core software license, and no software can eliminate all risks of device failure, accidental deletion, or data loss.
4. OPTIONAL AI FEATURES
AI assistance is optional and separate from non-AI Core Archive use. For an eligible retail purchase, Included FareCo AI is available until its limited usage allowance is exhausted or until 365 consecutive 24-hour days after the first successful activation of the retail software license, whichever happens first.
Purchase, download, installation, and first AI use do not start the 365-day clock. Included AI is not a monetary balance, does not renew automatically, and is not restarted or replenished by an additional device, reinstall, replacement license, or re-download.
AI requests require applicable eligibility and online services. Relevant information from an AI request may be processed using external AI services as explained in FareCo's applicable privacy information. AI-generated output can be incomplete or inaccurate. You are responsible for reviewing it before relying on it.
Ending Included AI does not end your perpetual non-AI license or remove your locally maintained archive materials.
5. PERMITTED USE AND LICENSE PROTECTION
You may use FareCo Archive within your licensed household and keep reasonable copies of the installer for your own authorized use. You must not publish or commercially redistribute license keys, provide unauthorized copies for other households, resell the software as your own product, or deliberately circumvent activation and usage controls. This section does not restrict rights provided by applicable law or applicable third-party software licenses.
Contact support@fareco.ai for device-replacement or license-transfer questions. This EULA does not promise an automatic transfer or additional device entitlement outside the approved license limits.
6. UPDATES AND THIRD-PARTY COMPONENTS
Your perpetual license covers the purchased Founding Edition. FareCo may provide fixes or compatible updates but does not promise indefinite support, all future major editions, or compatibility with every future operating system or device.
FareCo owns or licenses its software, documentation, branding, and other original product materials. Some components may have separate open-source or third-party licenses; those terms control the rights granted for the applicable components.
7. PURCHASES, REFUNDS, AND CORE CONTINUITY
The Terms of Sale and Refund Policy applicable to your purchase control its price, digital delivery, refund eligibility, and purchase-related Included AI benefits. Initial U.S. Secure Download purchases include the approved 30-day satisfaction guarantee under that policy.
Under FareCo's ordinary completed-full-refund policy, paid-AI benefits associated with the refunded purchase end. Your perpetual non-AI Core license rights remain available under the existing activation and device rules, and FareCo does not remove your local archive materials or previously generated content to enforce an ordinary refund. This EULA does not reduce your satisfaction guarantee or rights that cannot legally be excluded.
8. WARRANTIES AND RESPONSIBILITY
TO THE EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR EXPRESS PROMISES IN THE APPLICABLE TERMS OF SALE, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE." FARECO DISCLAIMS OTHER WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT SUCH DISCLAIMERS ARE ALLOWED.
Software may have defects or compatibility issues. Optional online services may be interrupted, and AI output may be incorrect. You should keep backups and check important information independently. Nothing here withdraws the express satisfaction guarantee or nonwaivable consumer rights.
9. LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY LAW, FARECO IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, ARISING FROM USE OF THE SOFTWARE. TO THE EXTENT PERMITTED BY LAW, FARECO'S TOTAL MONETARY LIABILITY FOR CLAIMS ARISING FROM THIS EULA WILL NOT EXCEED THE ORIGINAL PURCHASE PRICE PAID FOR THE AFFECTED SOFTWARE LICENSE.
These limitations do not restrict the express satisfaction guarantee or liability and remedies that applicable law does not allow FareCo to exclude or limit.
10. AGREEMENT VERSIONS AND CONTACT
This EULA applies to the version presented and accepted for your installation. Publishing a later EULA does not, by itself, establish acceptance of new terms or remove rights already granted for your purchase. The applicable Terms of Sale govern purchase and refund questions if their provisions differ from this EULA.
